EU FLAG and COPYRIGHTS

Today i got an email from the EC, ( The European CommissionInes GEORGIEVA

They asked me to stop using the EU Flag on posts, links and in youtube video's.

After 5 days in Brussels, and a lot of online content publishing and coverage about the EWRC 2017 on twitter, soundcloud and youtube, EUIA PRESS made a statement and started to become visible at the EU as an independent press organisation and platform for journalists.

The websites can be better, the publishing should become more professional and doing coverage on stories related to the EU, EC,  or any political or HR development organisation, non-governemental or governemental should become easier and more efficient by doing it.
In this EUIA PRESS we only need more people, more journalists, more starting journalists and people who are willing and able to create online pubicatons.


An independent PRESS organisation always gets resistance.
But at first i wouldn't believe it.

It was a letter about the usage of the EU Flag on sites, social media and in the youtube video made to show the EUIA PRESS and EUInternationalAcademy mission statement.


Unfortunately, the uses that were clearly identified in the attachment cannot be considered as uses "in press" as the European emblem and logo of the Commission are not used in the context of news articles or in order to illustrate news information. On the contrary:  

1 )The European emblem is used as a header/ banner on the website of your association with reference to the European Union official website "europa.eu

2) The European emblem is also displayed in your social media headers/banners net to the name do your association:

The EU inherited the flag's use when it was formed in 1993, being the successor organisation to the EC. It has been in wide official use by the EU since the 1990s, but it has never been given official status in any of the EU's treaties. Its adoption as an official symbol of the EU was planned as part of the proposed European Constitution, which failed to be ratified in 2005. Alternatively, it is sometimes called the Flag of the European Union when representing the EU.

NO IT IS NOT USED AS A DECLARATION OF ASSOCIATION BUT SHOWS THE AWARENESS AND ACTIVE PRESS RELEASES ON THE SITE. AS THE EWRC 2017 HAS BEEN COVERED AS EXTERNAL PRESS IT IS COMMUNICATING PART OF THE PRODUCTION FOCUSSES. EU FLAG ISNT OWNED BY ANY ORGANISATION.
LINKS TO THE EC OR EU SITES PROVIDED ARE CLEARLY SHOWN AS INFORMATION AND  PARTS OF THE PRESS RELEASES SHOW THE INDEPENDENCE OF EUIA PRESS AS AN OPEN PRESS PLATFORM FOR JOURNALISM AND JOURNALISTS AROUND THE GLOBE.

EUIA PRESS AND EUINTERNATIONALACADEMY NEVER INTEND TO GET ANY PUBLIC MISUNDERSTANDING ABOUT THE EU, EC OR ANY EUROPEAN RELATED ORGANISATION. AS AN INDEPENDENT PRESS IT RELEASES INTERVIEWS AND TEXT REPORTS ABOUT MEETINGS DONE BY JOURNALISTS OF THE EUIA PRESS PLATFORM. CLEARLY IT SHOWS NO CONNECTION AND NO FUNDINGS FROM THE EU AND PROVIDES ALL NECCESARY INFORMATION TO THE PUBLIC AND ITS USERS TO UNDERSTAND IT IS A FREE ORGAN AND PLATFORM FOR PRESS EDUCATION WORLD WIDE AND ONLY SHOWS PRESS COVERAGE ON SITES AND SOCIAL MEDIA WITHOUT ANY INCLUSION OF A STATEMENT TO BE INVOLVED AS PARTICIPANT ON EU LEGISLATIONS. 
ACCESS TO THE FLAG OR ANY INFORMATION PUBLISHED BY EC AND EU AND LINKING TO THE SITES IS A PUBLIC OPEN RIGHT AND PRESS FREEDOM AND FOR ALL GLOBAL CITIZENS A MANDITORY RIGHT 
EUIA PRESS CLAIMS AND OFFERS GLOBAL (PEACE) PRESS RELEASES AND TRANSPARENCY TO THE PUBLIC. 

Hopefully hereby i have informed you on this issue.

Dear Mr Gabeler,

Thank you for your prompt reply.

Unfortunately, the uses that were clearly identified in the attachment cannot be considered as uses "in press" as the European emblem and logo of the Commission are not used in the context of news articles or in order to illustrate news information. On the contrary:

This type of use is not in compliance with the Administrative Agreement dated 8 September 2012 as:

(a) the use creates the impression that there is a connection between your association and the institutions or bodies of the European Union
(b) the use leads the public to believe that your organisation benefits from the support/sponsorship  of the institutions or bodies, of the European Union or the Council of Europe

If you need more time to remove the unauthorised uses, please let us know.

We hope that an amiable solution to the issue mentioned above can be found within the established deadline and that no further action by the Commission will be necessary.

in case of the use of any EU logo, i would like to inform you about our freedom of press rights, EUIA PRESS is a journalistic platform announcing not to be ruled by any EU fund and provides free educational tools and links about EU and Global issues.

The EU Law considers the use of any logo in articles of press related to the story or services as legal.

Hereby i request you to submit THIS CASE OR ANY OTHER PRESS RELATED PUBLICATION by euia press as a clear site publication on freedom of press rules, as EUIA PRESS takes care of the clear point of view.

Dear Mr Gabeler,

The European Commission has identified several unauthorised uses of the European Commission's logo and the European Emblem on your organisation's website https://sites.google.com/site/euiapress/ (please refer to the attachment "Unauthorised uses").

The logo of the European Commission may be used by third parties only if permission is requested and granted before the logo is used and it is not used to imply or suggest unintended endorsement or promotion of the objectives and activities of the user of the logo by the European Commission.

The European Emblem is protected under Article 6ter of the Paris Convention. The purpose of Article 6ter is to protect flags, emblems, abbreviations and names of international intergovernmental organisations. Therefore, any unauthorised use as trademark of the European Emblem is prohibited.

The rules on the use of the European Emblem by third parties were adopted by the Council of Europe and the European Commission in the Administrative Agreement dated 8 September 2012. According to the Agreement third parties may use the Emblem unless:

(a) the use creates the impression that there is a connection between the user and any of    the institutions or bodies of the European Union or the Council of Europe;
(b) the use leads the public to believe that the user benefits from the support also financial of any of the institutions or bodies, of the European Union or the Council of Europe;
(c) the use is in connection with any objective or activity which is incompatible with the aims and principles of the European Union or of the Council of Europe, or which would be unlawful.

We consider that the uses of the European Emblem and European Commission's logo, as identified in the attachment, on your website and social media lead the public to confusion and creates the impression that:
-             the services furnished by your company are endorsed by the European Commission which in reality have no control over such services and activities;
-             your organisation benefits from the support, approval or consent of the European Commission or the European Union, which does not exist.

Therefore, we kindly request that you cease immediately the use of the European Emblem and European Commission's logo, as identified in the attachment, in relation to your activities and that you remove them from your website(s), all associated social media pages (Facebook, Twitter, Youtube, etc.) and any other materials or business documents (if any).
